Dear Sir:
Receipt is acknowledged of your letter of April
23rd, referring to Finance Docket No. 14688, Yosemite
Valley Railway Company Trustee Abandonment, is which
case a hearing has been held, an examiner's report served
recommending that abandonment be permitted, and exceptions
thereto filed by the National Lead Company, the Petroleum
War Administration, and the War Production Board. Time
for filing answers to the exceptions expires May 21.
It is noted that you propose to organize a new
corporation to take over the properties and to continue
their operation. You request to be advised of the procedure
necessary to present your interest in the case.
In view of the present status of the proceeding,
if you desire to participate in the case a petition for
leave to intervene should be filed, setting forth the
purpose of the intervention and showing good cause why
you did not appear in the case prior to or at the hearing.
See Rule 72 of the Commission's Rules of Practice. If the
purpose of the intervention will be to request the Commission
to impose a condition in its certificate, it issued,
that the line shall be sold to any responsible person, firm,
or corporation offering to purchase the same for continued
operation and willing to pay not less than the net salvage
value thereof, no doubt the Commission would desire,
information as to the ability, and plan, of the proposed
purchaser to finance the transaction.
